Real Estate Disputes

Experienced solicitors in respect of real estate disputes

Real estate or property disputes can arise in multiple ways but particularly in respect of property ownership, between landlords and tenants, and relating to development project contracts. When they do, our experienced team can deal with negotiation and settlement, interpreting and advising on contractual and commercial matters, and the conduct of any necessary proceedings. Our team has experience of commercial and residential properties and understand the importance of managing the relationships of the people involved.

Disputes in relation to property ownership

Whether it’s a dispute between family members about ownership, sale or development of a property, or an issue about co-ownership of property, Land Registry anomalies or a commercial sale or purchase, there can often be a number of complicating features. In particular with a commercial sale, there may be issues regarding the pre-sale information such as planning consents, lawful use certificates and surveys, or the due diligence. A professionally drafted sale agreement that contains any retained rights and any special conditions that have been agreed is essential and there may be additional issues to resolve if the property is sold with tenants or at auction.

Commercial landlord and tenant disputes

Commercial landlord and tenant disputes will need quick intervention to prevent them escalating into something more problematic resulting in lost income or disruption to business. Common areas of dispute include rent arrears and reviews, service charge recovery, commercial lease renewals, dilapidations and repair disputes, breach of covenant, forfeiture and surrenders, and issues in respect of assignment, subletting and change of use. Our team will do everything they can to resolve the matter quickly and cost effectively, and if settlement is not possible, we will assist in the preparation and conduct of legal proceedings.

Property development disputes

Property development can be a long process that will require a carefully negotiated contract and can involve multiple parties. And whilst property development can offer many opportunities, it often also brings with it, its own challenges. There may be issues with investors and the funding strategy, or there may be issues with the planning authority and application, and there can be disputes over the terms of the contracts and agreements to be reached.

Our team and expertise

Property law can be extremely complicated and there is often a wealth of statutory and common law to contend with as well as complex business relationships at stake. Our team has experience of negotiating on behalf of and acting for both purchaser and sellers, landlords and tenants, and developers.
