If you find yourself facing or potentially facing an insolvency situation, it can feel like a very dark time. In these circumstances it is important to get advice help as quickly as possible. There are important legal and regulatory requirements considerations as a director if your business is in financial distress. But it may also be possible to protect you or your assets and there may be other options available to you in the shape of restructuring or business rescue. Above all else however, it isreally important to take independent advice at the earliest opportunity to try to ensure the best possible outcome.

Company rescue

Business rescue services are aimed at restructuring an organisation with a view to returning it to solvency /avoiding insolvency or bankruptcy. There are various schemes, restructuring plans and proceedingsthat may be available which include the temporary supervision of the company, and the management of its affairs, business and property by a business rescue practitioner, a temporary stay on the rights of claimants against the company and the development and implementationof a business rescue plan to rescue the company. This may include restructuring its business, property, debt, affairs, or other liabilities and/or the instigation of administration or company voluntary arrangement procedures.

Director disqualification

It’s vital that as a director you understand your legal responsibilities. Director disqualification is a ban from serving as a director for any UK registered company, or an overseas one with UK connections. This includes the creation of, or running of, any firm. Director Disqualification proceedings are brought against directors although it is not necessarily just the directors registered at Companies House who may be the subject of an investigation or court proceedings.
Furthermore, breaking the terms of a company director disqualification can lead to a fine or prison sentence of up to two years.
