Assigning a Certificate of Sponsorship
Although we anonymise our case studies, we use them to illustrate common UK visa issues with which we have helped clients in the past.
The client
A UK company struggling to find UK workers who has identified a suitable candidate from India.
The issues
The candidate requires a work visa sponsored by the company. Due to staffing issues within the company, they need the new recruit to obtain their visa for the recruit as quickly as possible. Fortunately, the company already holds a sponsor licence.
The approach
The company will need to obtain a certificate of sponsorship and assign it to the recruit. The processing of this can often be delayed because the Home Office request more information – information that may not be obvious when using the sponsorship management system (which has limited capacity for providing further information). Familiar with the sort of questions the Home Office are likely to raise, we can anticipate any issues in advance which avoids unnecessary delays. Such assistance may be by way of providing a covering letters or more information about the need to employ the recruit.
If there is a risk that the recruit may be called for a Home Office interview, help can be provided in the form of mock interviews with constructive feedback and reassurance.
The outcome
Unnecessary delays are avoided, and once approved, the recruit can apply to enter the UK as a Skilled Worker. Skilled Worker visas should be processed withing three weeks.
